Overview Laura D'Amato is a Director in the Litigation and Employment groups. She represents corporate and individual clients in a variety of forums, including state and federal court and administrative proceedings. Her practice focuses on a variety of complex litigation matters, including probate litigation, employment disputes, professional malpractice claims and various contractual and real property related matters. Representative Experience ˇ Successfully argued in opposition to appeal before the United States Court of Appeals for the First Circuit regarding the applicability of ERISA's anti-alienation provision to pension benefits after disbursement. ˇ Represented a trustee in an action to determine the proper charitable beneficiary under a trust instrument that contained precatory language regarding the use of the proceeds by the charitable beneficiary. ˇ Obtained a judgment in favor of individual heirs who were seeking to secure the proceeds of a lapsed gift under a will. ˇ Obtained a defense verdict in jury trial against landowner sued for negligence and nuisance. ˇ Obtained summary judgment in matter challenging the validity of a real estate transaction. ˇ Represents clients on a continuing basis before the Massachusetts Commission Against Discrimination and the Equal Employment Opportunity Commission in discrimination claims arising out of the employment relationship. ˇ Represents clients on a continuing basis in cases involving allegations of professional negligence, breach of fiduciary duty, and various contractual matters.
