The laws of removal in a divorce action prohibits the unilateral removal of a child from the Commonwealth without court permission or assent of the other parent. However, whether you are married or unmarried, the issues of relocation as a result of a case that I was directly involved in, Wakefield v. Hegarty, are the same. Removal cases are heart wrenching to deal with. If successful, the parent left behind will be distraught as a result of the loss of day to day experiences with the children. There are ways to mitigate the sting however. I have represented many people both seeking to remove to a foreign state or country or objecting to the removal. If you are involved in such a problem, I will be happy to meet with you. I am passionate about protecting children and parents’ rights, and I do not hesitate to seek relief in the probate court, the Appeals Court, or the Supreme Judicial Court.
