When people meet with me to discuss restraining orders, they are referring to Massachusetts General Laws, Chapter 209A. 209A’s are designated the non-abuse statute, and are intended to protect members of the family from physical abuse, emotional abuse, and the threat of imminent harm. This law is a very powerful one, because the issuance of the restraining order pursuant to that statute has very dramatic ramifications. There are definite reasons why Massachusetts enacted such a powerful statute. No marital partner should be abused and/or forced to do something that he/she does not want to do, and when circumstances warrant, I encourage my client to apply for the restraining order.
