Florida is considered a "no-fault" state regarding the basis for a divorce. In other words, you don't have to prove adultery, mental abuse, etc. to obtain a divorce. The majority of people use "irreconcilable differences" as the reason for the divorce.
However, I have had some clients come to me and inform me his/her spouse filed for a divorce and my client wants reconciliation. There is a way to request the Court order marital counseling in these situations. Pursuant to Florida Statute 61.052(2)(b), when there is a minor child of the marriage, and the party not seeking the divorce denies the marriage is irretrievably broken, the court may order either or both parties to consult with a marriage counselor, psychologist, etc., to seek consultation. Further, the court may continue the proceedings for a reasonable length of time, not to exceed 3 months, to enable the parties to effect reconciliation.
This is good news for a person who believes his/her marriage suffers from communication issues and can be saved. Although I do advocate strongly for clients in a divorce, because sometimes a divorce is best for all parties involved, my heart always hopes reunification is possible.
