Larry Kulig has over 25 years of broad commercial litigation experience, with particular focus on disputes involving partnerships and closely held businesses, lender/borrower disputes and real estate, corporate and trademark related litigation including claims involving First Amendment and property rights on the Internet and websites. He has approximately 16 reported decisions on WESTLAW, jury and bench trial experience and has argued before the Massachusetts Appeals Court and Supreme Judicial Court (as well as appellate courts in other states). In addition, Larry is experienced in alternative dispute resolution, including both as arbitrator and mediator.
Representative Matters
· Representation of family business in landmark suit against private lender for unfair and deceptive practices, resulting in jury award, multiple damages and attorneys fees in excess of $5 million, affirmed by Massachusetts Supreme Judicial Court. Kattar v. Demoulas, 433 Mass. 1 (2001);
· Pursuit of fraud claims by investors in limited partnership against managing general partners, resulting in Massachusetts 7 figure judgment, enforceable in Tennessee . W & T, Inc. v. Ham, 2009 WL 225256 (Tenn. Ct. App.);
· Representation of national denomination in dispute with local disaffiliating church over ownership of $40 million of assets, including rulings by both Massachusetts Appeals Court and Supreme Judicial Court regarding First Amendment (church/state) issues. General Convention of New Jerusalem v. Boston Society, 66 Mass. App. Ct. 836 (2007), 449 Mass. 832 (2008);
· Defense of publicly traded tax credit syndicator in dismissal of claims for breach of fiduciary duty and contract, affirmed by Texas Court of Appeals. Cricket Hollow Partners v. MMA Cricket Hollow, No. 01-08-00254-CV (July 16, 2009).
