Lewis and Roca has an extensive real estate practice. The firm's real estate practice is diverse, and encompasses land acquisition and development, acquisitions of income-producing and all other types of real estate, portfolio acquisitions, commercial leasing, land use, owners' associations, master planned communities, mortgage lending and other real estate finance transactions, foreclosure, loan work-outs and restructurings. The lawyers within (or available to) the Real Estate Practice Group also advise clients on the corporate, partnership, limited liability company and other entity aspects of a particular transaction.
  • Real Estate Lending Transactions
Lewis and Roca represents lenders, borrowers, investors and guarantors in a broad range of real estate financings. We counsel local banks, regional banks from the Southwest and other parts of the country, national banks, insurance companies, conduit lenders, finance companies, mortgage companies and other institutional lenders in all aspects of the origination, modification and restructuring of loans secured by interests in real estate. Our attorneys have represented lenders in acquisition and development loans, construction loans, permanent loans and other creative loan structures relating to single-asset and portfolio loan transactions involving all types of commercial properties, including office, retail, industrial, multifamily, residential, condominium, mixed-use and hospitality properties. We handle all aspects of a real estate loan transaction from structuring, developing and negotiating loan documentation, to conducting diligence and perfecting liens and security interests in collateral, to loan participations, syndications and intercreditor agreements in multi-lender transactions.
