Linda M. Weinberg is a partner in Barnes & Thornburg LLP's Washington, D.C. office and is a member of the firm's Corporate Department and the Global Services Practice Group. Ms. Weinberg assists clients with various international trade law issues, including export controls, foreign assets control and customs. She works regularly with the U.S. and foreign government agencies that regulate international trade.
Ms. Weinberg advises and represents clients on export classification, licensing, technical assistance agreements, and enforcement relating to defense articles and "dual-use," encryption software, and technical data and services. Her experience extends to a range of industries, including aerospace, satellite, nuclear, electronics, defense, security, and software. In addition, she provides clients with counseling, licensing services, and enforcement representation with respect to U.S. economic sanctions, related USA PATRIOT Act issues, antiboycott regulation, and CFIUS.
Ms. Weinberg's practice also encompasses customs, NAFTA and other duty preferences, country-of-origin marking, valuation, classification, security, transportation issues, domestic preferences and enforcement of intellectual property rights. She resolves complex NAFTA verifications, seizures, voluntary disclosures and penalties. Ms. Weinberg has successfully pursued binding rulings, regulatory changes, protests, petitions and litigation. She also assists clients with enforcement by U.S. Customs and Border Protection of exclusion orders issued by the International Trade Commission under Section 337.
Ms. Weinberg teaches basic and advanced level courses across the country on compliance with U.S. export control laws and regulations, including the International Traffic and Arms Regulations, the Export Administration Regulations, and other relevant U.S. government regulations.
Ms. Weinberg received a B.A. in 1983 from the University of California at Irvine and earned her J.D. in 1987 from Loyola Law School-Los Angeles. She was a member of the Loyola of Los Angeles Law Review and authored "On Whose Behalf? Underlying Conflicts of the Antidumping Standing Rules," 20 Loy, L.A.L. Rev. No. 2, 573-95 (1987).
Ms. Weinberg is a member of the Customs Law and Export Controls and Economic Sanctions Committees of the ABA Section of International Law. She is admitted to practice in the District of Columbia and Maryland and before the U.S. Court of International Trade, the U.S. Court of Appeals for the Fourth Circuit, and the U.S. Supreme Court.
