Within our comprehensive estate planning practice, we represent individuals with respect to their estate planning and individual and corporate executors, beneficiaries of successions, trustees and trust beneficiaries in the administration of estates and trusts. Our estate planning attorneys, which include a Louisiana Bar Association certified estate planning and administration specialist, also assist out-of-state law firms with ancillary administrations in Louisiana.
Individual clients depend on our firm for professional advice regarding wills, gift giving, charitable donations, life insurance trusts, tax planning and other matters related to estate planning. We also counsel owners of closely held businesses on future ownership and management matters, corporate executives on the handling of pension funds and other retirement benefits, and nonresident owners of Louisiana real estate and mineral rights on estate and trust issues.
Trusts and Estates/Successions Litigation
Our litigators routinely represent executors, trustees, individual beneficiaries and large trust departments in disputes involving will contests, seizures of beneficial interests in trust, collection of loans to a trust, breach of fiduciary duties and claims for accounting.
Recently, we successfully litigated a challenge to a testamentary instrument of a multi-million dollar estate brought by the proponents of a purported olographic will. Our attorneys also successfully represented the trustees in a significant case before the United States Fifth Circuit Court of Appeals. This matter involved the invasion of trust principal for the benefit of a seizing creditor in abrogation of the discretion accorded to the trustees in the trust instrument. Read v.
