Lou Doherty is a partner and practices in the areas of employment law and fiduciary duty and fraud litigation. He advises employers on a wide variety of employment-related matters with an emphasis on avoiding litigation and compliance with the wide range of laws affecting the employer-employee relationship. He also assists employers in defense of agency investigations (such as EEOC and DOL investigations) and defending litigation brought in both federal and state courts. He has represented employers in many instances in other disputes in the employment area, including breach of fiduciary duty litigation against employees, OSHA contests in both state and federal plan states, and ERISA litigation brought by participants in employee benefit plans. Because of his representation of employers in fiduciary duty litigation against former employees and his experience in obtaining creative remedies, Mr. Doherty has also represented health plans and insurers in breach of fiduciary duty and fraud claims against health care providers that have engaged in fraudulent billing in the health care system. Mr. Doherty has been named to Business North Carolina's Legal Elite List in the area of Employment Law in 2003 and 2005. He was also recognized as an Employment Litigation "Super Lawyer" in the 2006 North Carolina Super Lawyer magazine. Mr. Doherty is also listed in the 2007 and 2008 editions of The Best Lawyers in America for Labor and Employment Law. Selected Practice Highlights · Represented employers in numerous sexual harassment claims and litigation, sex discrimination actions, race discrimination actions, age discrimination actions, and numerous ancillary state law tort claims, including wrongful termination, intentional infliction of emotional distress, and negligent infliction of emotional distress. · Counsel to employers in numerous successful breach of fiduciary duty actions against former employees, including one establishing new law in North Carolina at the North Carolina Supreme Court. · Represented insurer, plan administrators and health plans in breach of fiduciary duty and fraud claims against health care providers engaged in billing fraud and malfeasance, including one that involved a nine-week jury trial and millions of dollars of claims. · Counsel to employers in numerous successful OSHA contest actions in both federal and state plan jurisdictions. · Represented employers in obtaining summary judgment on ERISA claims by participants. · Obtained injunctions (as well as successfully defeated injunctions) in covenant not to compete litigation and disputes with former employers and employees.
