Luke van Houwelingen is an associate in Crowell & Moring's Washington, D.C. office. He practices in the Litigation and Environmental & Natural Resources Groups. His experience includes representing corporations in antitrust and other complex civil litigation and arbitration, and client counseling and litigation under the Clean Water Act and other environmental statutes.
Luke recently represented DuPont in defense of antitrust counterclaims brought by Kolon Industries for monopolization and attempted monopolization under Section 2 of the Sherman Act. In April 2012, on the eve of trial, the Eastern District of Virginia granted summary judgment for DuPont and dismissed Kolon's counterclaims with prejudice. This was the second major win in Crowell & Moring's work for DuPont stemming from trade secrets litigation against Kolon. The first was a jury award of $919.9 million for DuPont for theft of trade secrets related to DuPont's Kevlar® business and technology. Luke's other recent matters include:
· Representing a Class I railroad in defense of a multi-district class action litigation alleging conspiracy to fix fuel surcharge prices.
· Representing major trade associations in a successful challenge to EPA Clean Water Act regulation in federal appellate court.
· Representing a major trade association in litigation against EPA challenging a nationally significant Total Maximum Daily Load (TMDL).
· Representing a mining company in a challenge to orders of the Federal Energy Regulatory Commission (FERC) in federal appellate court.
· Representing a Class I railroad in arbitration against a transportation logistics company involving a complex contract dispute.
· Representing a leading server manufacturer as a plaintiff in DRAM chip price-fixing litigation to recover overcharges caused by an international cartel.
Luke clerked for the Honorable Helen G. Berrigan, Chief Judge of the United States District Court for the Eastern District of Louisiana in 2007-2008.
Luke received his J.D. from Georgetown Law Center in 2007, graduating cum laude. While at Georgetown, he served as Executive Articles Editor for the Georgetown Journal on Poverty Law & Policy and as Vice President for Programming for the American Constitution Society. He also participated in the Georgetown Federal Legislation Clinic. During law school, Luke was an intern in EPA's Water Enforcement Division and at the U.S. Department of Justice, where he participated in a major Clean Water Act enforcement action. Luke received a Bachelor of Music degree from the Manhattan School of Music in 2002.
