Biography

Lyndsey is an Associate in the firm's Labor and Employment Law Department. Her practice focuses on representing and advising employers in all aspects of labor and employment law. She frequently defends clients against discrimination, harassment and wage and hour lawsuits. Lyndsey also has experience representing clients in disputes over consulting agreements and employment contracts. In addition, Lyndsey drafts employment agreements, handbooks and policies in order to help ensure that employers comply with both state and federal employment law statutes. She also advises clients on these topics when issues and questions arise.

Lyndsey has significant experience advising on union-related concerns such as organizing campaigns, decertification elections, labor arbitrations, neutrality agreements and collective bargaining. She has successfully defended management in disputes with unions, ranging from just cause termination to contract interpretation.

As part of her practice, Lyndsey represents employers in federal and state courts, before administrative agencies including the Massachusetts Commission Against Discrimination, Equal Employment Opportunity Commission and the National Labor Relations Board, as well as before the American Arbitration Association. Prior to joining the Foley Hoag LLP, Lyndsey interned at the Department of Labor Office of the Regional Solicitor.

- Successfully defended an employer in a pregnancy-related reasonable accommodation case

- Represented a hotel in a federal religion and national origin discrimination case

- Successfully challenged the results of a union organizing campaign based on the union's misconduct

- Obtained a favorable decision against a union employee who claimed he was terminated without just case and on the basis of his age

- Advised a client regarding independent contractor misclassification audit and designed a method to ensure proper classification in the future
