Madelein Perrick is a member of Mayer Brown's Government and International Trade group in Brussels. Her practice focuses on international trade and customs law.
Madelein has been recommended as trade and customs lawyer in Chambers Global 2010.
She represented clients in trade defense cases before the EU institutions and assisted them in preparing responses to questionnaires, injury and Community interest submissions, hearings before the Commission, appeals to the European Court, and lobbying activities vis-a -vis the Member States. She also defended the interests of European exporters to third countries which are accused of dumping.
She regularly advises clients on the many preferential trade agreements the EU has concluded with third countries as well as on the EU's Generalized System of Preferences (GSP), in particular on the rules of origin contained therein and how and where companies can best make use of these arrangements in terms of customs duty savings.
She further advises clients on the EU's non-preferential rules of origin and on origin-marking requirements.
Madelein has also extensively advised and represented clients on tariff classification before the EU and EU Member States' authorities as well as before the WCO on a wide range of products from electronics and textiles to chemicals and sanitary products. She further advises on EU and WTO customs valuation matters ranging from questions on what sale to use for transaction value to the dutiability of royalties and commission payments and the like. She also deals with questions on economic tariff regimes such as inward processing and processing under customs control or on duty suspensions and tariff quotas. She regularly advises on repayment and remission procedures before national customs authorities.
Madelein also deals with a number of market access issues involving Articles I, II and III of GATT 1994, the Origin Agreement, as well as the TBT and SPS agreements and on the EU's market access strategy. She further advises on the EU provisions on export controls and economic sanctions.
With regard to EU regulation, she has advised on the EU's harmonization legislation including on standards and safety regulations, labeling issues and VAT-related matters, and also deals with EU institutional issues.
Madelein counsels clients on the interpretation of EU and international provisions on export controls and economic sanctions and on their implementation in EU Member States.
