Gosia Kosturek focuses her practice on employee benefits, general corporate and hospitality related work. While in law school, she won the ABA-BNA Award for Excellence in the Study of Labor and Employment Law, and was also the recipient of the CALI Excellence for the Future Awards for Employee Benefits; Property; Bankruptcy; Employment Discrimination; and Advanced Legal Writing: Writing in Law Practice.
Representative Matters
· Assists clients with qualified retirement plan administration and compliance with the Internal Revenue Code and ERISA including benefit claims administration, QDRO administration, correction of errors under EPCRS and VFCP, determination letter applications, and restatement of plan documents, etc.;
· Assists governmental employers in federal and state law compliance of employee benefit plans;
· Assists multiemployer pension and welfare plans with issues relating to multiemployer plan design and administration including withdrawal liability, plan funding, drafting and maintenance of plan document including reciprocal agreements, notice and disclosure requirements, etc.;
· Assists clients with issues relating to health and welfare plans including health care reform compliance, COBRA administration, HIPAA compliance, state law requirements that are not preempted by ERISA, etc.;
· Assists in drafting and negotiating hotel management agreements, purchase and sale agreements and consulting services agreement for hotel management companies and for hotel owners; and
· Managed the due diligence process and assisted in the preparation of the closing documents for the sale of a manufacturing company.
