Biography

Manuel Cairo's practice is concentrated on labor and employment, and immigration law matters. He represents employers in single and multi-plaintiff disputes in federal and state courts regarding discrimination, harassment, retaliation, breach of contract, wage and hour, trade secret, wrongful termination, business torts, and other types of employment matters. Manuel also has experience representing employers regarding occupational safety and health, and workers' compensation matters before the Industrial Commission of Arizona.

Manuel's practice also focuses on counseling employers on worksite enforcement and corporate compliance strategies. He regularly advises employers in developing comprehensive best practices designed to avoid employer liability under both federal and state immigration laws.

Manuel chairs the firm's Committee on Diversity & Inclusion and is a regular speaker and commentator on current employment and immigration issues.

Reported CasesRepresentative Experience Represented employer against plaintiff's allegation that he was denied promotion opportunities because of his race and national origin. Represented employer against plaintiff's allegation that his employer retaliated against him because he filed a charge with the Equal Employment Opportunity Commission. Represented employer against former employees who, while working for the employer, established a competing enterprise; affirmatively caused the employer to incur losses in operations; and wrongfully used confidential, proprietary and trade secreted information. Defended various employers against allegations of retaliatory employment practices in violation of the whistleblower provisions of the Surface Transportation Assistance Act, Arizona Employment Protection Act, and other similar statutes. Applied the mathematical and probability concepts of statistical significance (Four-Fifths and Two Standard Deviation Rules) in assessing employer's reduction in force. Represented employer against a dozen charges of discrimination simultaneously filed by employees with the Equal Employment Opportunity Commission. Represented employer against plaintiff's race and national origin discrimination and hostile work environment claims. Represented employer against a terminated employee who filed a charge of religious discrimination with the Arizona Civil Rights Division and subsequently filed suit for unpaid wages. Represented employer against plaintiff's sex discrimination, hostile work environment, disability discrimination, retaliation and negligent hiring claims. Counseled large employer through a complete restructuring of employment practices to address existing legal exposure exceeding several millions of dollars and to develop and implement written policies and procedures as well as comprehensive best practices consistent with employment laws. Represented employer and employee at all stages to obtain an injunction against harassment and an injunction against workplace harassment against a third party who was repeatedly calling, threatening and stalking employee at the place of business. Defended over 100 employers before the Equal Employment Opportunity Commission and Arizona Civil Rights Division.
