Biography

Mary Buttery is the lead partner in the Vancouver office's insolvency group, and the co-chair of the firm's national Business Solutions and Restructuring Group. She has been involved in numerous significant insolvency files in British Columbia, and her expertise is recognized nationally.

Specializing in the area of commercial insolvency, Ms. Buttery represents financial institutions, debtors and creditors, receivers and trustees in matters related to debt restructuring, corporate reorganizations, loan workouts, fraudulent preference actions, bankruptcy and receiverships.

In addition, Ms. Buttery is an experienced commercial litigator, with expertise in the enforcement of foreign judgments. She has lectured in insolvency and litigation matters, and has authored several articles on varied topics in her areas of practice. Ms. Buttery has appeared in all levels of the Ontario and British Columbia courts, the Federal Court, and has been lead counsel in the Supreme Court of Canada.

Ms. Buttery is recognized by numerous legal directories as a leader in her field.

Professional Experience

· Brookdale International Systems - Acted as restructuring counsel for this manufacturer who faced major claims arising out of a defective emergency smoke escape device

· Pine Valley Coal Ltd. - Acted as Co-Counsel in the mine's restructuring under the CCAA

· Restructuring counsel for Concert Industries Ltd. and its subsidiaries in a successful reorganization under the Companies' Creditors Arrangement Act and the Canada Business Corporations Act

· Vantage Securities Inc. - Acted as counsel for Trustee in bankruptcy and judicially appointed receiver in the first securities firm bankruptcy filed under Part XII of the Canada Bankruptcy and Insolvency Act

· In the Matter of the Bankruptcy of James Blair Down et al. - Acted for Arthur Andersen Inc. in its capacity as interim receiver in a bankruptcy case brought by the petitioning creditor against a large number of individuals and corporate entities. The case involved the issuance of bankruptcy warrants of seizure under the Canada Bankruptcy Act, Anton Piller orders and Norwich Pharmical Orders and included seizure of assets around the world.

· Agro Pacific Industries - Acted as counsel for debtor company (major Fraser Valley producer of feed and seed products for agriculture, poultry and livestock producers) in this CCAA reorganization proceedings

· New Home Warranty - Acted as counsel for trustee in bankruptcy in this Bankruptcy and Insolvency Act proposal filed by British Columbia New Home Warranty Company triggered by "leaky condo crisis" in British Columbia

· SNV International Ltd. - Acted as counsel for major North American debtor company employed in travel wholesaling industry under CCAA proceedings

· PricewaterhouseCoopers Inc. - Represented PricewaterhouseCoopers in their role as court-appointed Monitor in Companies' Creditors Arrangement Act proceedings commenced with respect to NEMI Northern Energy & Mining Inc.

· KPMG Inc. - Acted as counsel for KPMG Inc., the court-appointed Monitor in the Companies' Creditors Arrangement Act proceedings commenced by A&B Sound

· Tricap Restructuring Fund - Restructuring counsel for this major bondholder in the judicial reorganization proceedings of Doman Industries Ltd. under the Companies' Creditors Arrangement Act

· New Skeena Forest Products ("Skeena #3") - Restructuring counsel in New Skeena's reorganization proceedings under the Companies' Creditors Arrangement Act

· PricewaterhouseCoopers Inc. re Interact - Acted for PricewaterhouseCoopers Inc. the Court-appointed Monitor in the Interact companies' unsuccessful Companies' Creditors Arrangement Act proceedings

· KPMG re Exchange Bank and Trust Inc. - Acted for Receiver appointed by the British Columbia Securities Commission over bank deposits and securities held in Canadian chartered banks and brokerage houses in the name of an off-shore bank and against which various claims were being made by miscellaneous parties
