Professional Experience Mr. Kanny is a Partner in the firm's Litigation Division. His practice focuses on complex commercial litigation, class action defense, antitrust and trade regulation, unfair competition and false advertising matters, and entertainment litigation. Mr. Kanny formerly served as the Co-Director of the firm's National Commercial Litigation practice, Chair of the firm's Strategic Growth and Recruiting Committee and as a member of the firm's Executive Committee. Mr. Kanny represents clients in federal and state courts and in arbitration proceedings throughout the country. He is actively involved in all phases of litigation, from prelitigation counseling through trial and appeal. Mr. Kanny also provides strategic advice to clients in connection with a variety of legal and regulatory matters and has extensive experience representing clients in enforcement actions involving District Attorneys, Attorney Generals, the Department of Justice and others. Mr. Kanny's clients include leading companies in the automotive, retail, biotech, real estate, entertainment, technology and Internet industries. Representative Matters Mr. Kanny has served as lead counsel in a number of complex civil and putative class action matters across the United States. The following is a sample of his notable cases: · Representing a manufacturer of sheet metal automobile parts in defense of putative class actions brought by direct and indirect purchasers in the United States District Court for the Eastern District of Wisconsin. · Representing a manufacturer of sheet metal automobile parts against claims of predatory pricing and false advertising in the United States District Court for the Southern District of Ohio. · Representing a manufacturer of aftermarket auto lights in defense of putative class actions brought by direct purchasers in the United States District Court for the Central District of California. · Represented a manufacturer of aftermarket auto lights in defense of predatory and below cost pricing and antitrust claims filed in the United States District Court for the Central District of California. · Represented major retailer in a putative class action filed in the Los Angeles County Superior Court alleging that the retailer violated California's recycling act in connection with the retailer's advertising and refund policies. Trial court granted retailer's summary judgment. · Represented major retailer in putative class action alleging that the plaintiff had the constitutional right to engage in expressive activities on the retailer's private property. Trial court granted retailer's summary judgment motion; affirmed on appeal. · Represented a record distributor in a copyright infringement action in the United States District Court for the District of Oregon. Obtained defense verdict on behalf of record distributor on copyright infringement and unfair competition claims. · Represented a record distributor in a putative class action filed under California's unfair competition law alleging false advertising and fraudulent business practices relating to the manufacture and sale of CDs in California. Case dismissed after distributor filed summary judgment and sanctions motions. · Represented a major biotech company against the State of California. Case settled on favorable terms following bench trial. · Represented major retailer in a representative action filed under California's unfair competition law in connection with the retailer's vision centers in California. Case dismissed after retailer filed summary judgment motion. · Represented a petroleum refiner in defense of claims of price discrimination and unfair competition in Chancery Court in Arkansas. Case settled on favorable terms following bench trial. · Represented major retailer in a representative action filed under California's unfair competition law alleging violations of the Confidential Medical Information Act and California Constitution. Case dismissed after retailer's dispositive motion filed. · Successfully argued before the Ninth Circuit Court of Appeals, Bankruptcy Appellate Panel, on behalf of an electronics distributor concerning the appropriate statute of limitations period in a preference action filed under the Bankruptcy Code. · Obtained a peremptory writ of mandate from the California Court of Appeal compelling the Superior Court of California to dismiss breach of contract action filed by record producers against a British record label. · Represented sprinkler manufacturer in a trade secret misappropriation action brought by a former supplier. Case settled after manufacturer's dispositive motion was filed. · Represented talent agency in an action filed by certain concert promoters in the United States District Court for the Southern District of New York alleging civil rights and antitrust violations. · Represented publicly traded ticketing company in an action that involved novel questions regarding how copyright and common law rights function in cyberspace.
