Biography

Melinda Agee is Counsel in Stites & Harbison's Atlanta office. She represents institutional lenders and businesses in litigation related to bankruptcy, contracts, foreclosures, and workouts. She is a member of the firm's Creditor Rights and Bankruptcy Services Group.

Recent Assignments

· Obtained appointment of a receiver with authority to take over business operations within days of foreclosure on a commercial property, assuring there was no interruption in the on-going business and protecting the value of the collateral for marketing and resale of the secured property

· Reformed security deeds to add a necessary provision by equitable decree permitting national lender to proceed with non-judicial foreclosures based upon the reformed deeds

· Confirmed a foreclosure sale of a commercial property so that the lender was able to pursue the deficiency from the borrower and guarantors, after obtaining the bankruptcy court's order lifting the stay for the foreclosure and confirmation action

· Won judgment in lawsuit on guaranties against multiple parties, defeating claim of fradulent assignment to the creditor and after foreclosure of the collateral, obtained confirmation of the sale to pursue the deficiency

Before Stites & Harbison

Melinda was counsel to a boutique creditors' rights practice in Atlanta, working together with Lou Allen, before they both moved to Stites & Harbison. Many years before that, she began her legal career with the Georgia Legal Services Program, representing clients with consumer, family, housing, and other legal problems. Before turning to law, Melinda was a high school English, Music and drama teacher and a Peace Corps volunteer in West Africa.

More Than Stites & Harbison

Through Georgia Legal Services Program's pro bono project, Melinda volunteered representation to nursing home residents. She has also given pro bono services to the Grandparent Relative Caregiver Project of Atlanta Legal Aid Society. Melinda has served as an officer, board member, and volunteer with the Women's Policy Group and Women's Policy Education Fund, which promote public policies important to women, girls, and their communities.

Melinda loves to travel and explore other cultures, is a year-round gardener, and enjoys opera and mysteries.
