Michael Kimberly briefs and argues complex appeals and dispositive motions. He has argued eight appeals in courts throughout the country, including before en banc sittings of the Second and Eleventh Circuits. He has been the principal brief-writer in more than a dozen cases before the Supreme Court and dozens more before all thirteen federal courts of appeals. According to Reuters (2014), Michael is among “the top handful of lawyers in America” and the “elite of the elite” who are “extreme outliers” in their success practicing before the Supreme Court.
Michael has particularly deep experience with the antitrust laws, environmental law and constitutional law. His antitrust experience includes defending a broad range of Sherman and Clayton Act cases, with emphasis on price-fixing conspiracies, attempted monopolization and international jurisdiction and extraterritoriality. His environmental litigation practice focuses on the Clean Water and Clean Air Acts and their implementing regulations. And in the constitutional litigation context, Michael has substantial experience with provisions important to the business community, including the Commerce, Takings and Due Process Clauses. Principally in connection with his pro bono work, Michael also frequently handles appeals involving the First and Fourth Amendments.
Michael co-directs the Yale Law School Supreme Court Clinic, which regularly represents civil rights, immigrant, and criminal defense litigants before the Supreme Court. He also is an associate member of the Edward Coke Appellate Inn of Court and a regular participant in the Georgetown Supreme Court Institute.
A summa cum laude graduate of Princeton University, Michael received his JD from the Yale Law School, where he served as Editor of The Yale Law Journal and Executive Editor of the Yale Law and Policy Review. Following law school, Michael clerked for Judge Michael Daly Hawkins on the US Court of Appeals for the Ninth Circuit.
