Mike Castellon, a member of Sutherland's Litigation Practice Group, has more than 20 years of legal experience in construction law, contracts and all types of dispute resolution. His clients include developers, general contractors, public and private owners, subcontractors, engineering service providers and commercial vendors.
Representative Experience
Mike's extensive trial, arbitration, mediation and alternative dispute resolution experience includes:
· Multiple power plants, industrial facilities and commercial and infrastructure projects.
· Jury and bench trials and proceedings in the state and federal courts of several states.
· Arbitrations (private, ICA and AAA) in multiple states.
· Board of Contracts Appeals trials and proceedings.
· Mediations and alternative dispute resolution proceedings in numerous matters.
Mike has prepared and negotiated contracts, RFPs, and EPC agreements for a variety of clients, and is experienced with the American Institute of Architects (AIA), The Associated General Contractors of America (AGC), Design-Build Institute of America (DBIA), Engineers Joint Contract Documents Committee (EJCDC), Leadership in Energy and Environmental Design (LEED), U.S. Department of Housing and Urban Development (HUD), Federal Acquisition Regulation (FAR), Code of Federal Regulations (CFR), Rural Utilities Service (RUS) and other industry documents and regulations. His representative contracting experience includes:
· Negotiating an EPC Agreement for a 550 MW solar PV facility in California.
· Drafting and negotiating numerous solar PV EPC Agreements for a 2M to 30 MW project in New Jersey, Arizona, California and other areas.
· EPC Agreements for Land Fill Gas Collection Systems and other biomass facilities.
· Procurement agreements for combustion turbines and generators for a large utility in Florida.
· RFP and design/build contract for the City of Atlanta Public Safety Headquarters Building.
· Design/build contract for expansion of a tire manufacturing facility in North Georgia.
· Engineering procurement construction (EPC) contract for a 20MW waste-to-energy power generation facility in North Georgia.
· Engineering services agreement for a natural gas storage salt dome project in Texas.
· Engineering and construction agreements conforming to RUS requirements for power cooperatives in Kentucky, Georgia and Montana.
· Material handling and equipment services agreements for automated production facilities in Canada, Georgia, Wisconsin and Pennsylvania.
· General construction contracts for commercial, office, medical, industrial and retail developments in Texas, South Carolina, New Jersey, Missouri, Georgia, Virginia, California and Alabama.
