Michael Davis finds ways to solve his clients' problems-either with innovative business solutions or through litigation or dispute resolution. His practice often focuses on environmental issues encountered in construction and redevelopment, including: · redevelopment of impaired properties or Brownfields · environmental and construction insurance and liability-risk transfer agreements · public/private partnerships · environmental litigation, including CERCLA cost recovery, NEPA challenges, wetlands issues, and toxic torts. He has been involved in some of the most significant redevelopment projects in the country-from the World Trade Center in Manhattan to the Poplar Point redevelopment project in the District of Columbia. Mr. Davis is also frequently called on to help in the acquisition of high-value insurance policies and related coverage disputes. He has significant experience representing drug, medical device and dietary supplement manufacturers in litigation and dispute resolution. All of his clients benefit from his 15 years of experience working with federal, state, and local governmental agencies, as well as his tireless work ethic. Representative Clients Mr. Davis counsels governmental entities and companies in a wide range of industries- construction, government contracting, manufacturing, urban development, pharmaceuticals, risk transfer and financial services. Examples include: · a government agency redeveloping the World Trade Center Site in Manhattan · a municipality engaged in significant redevelopment along the Anacostia River in Washington, DC · a private developer in connection with a Brownfield site on the East River in New York City Significant Matters · an amicus brief on behalf of former administrators of the Environmental Protection Agency before the U.S. Supreme Court (Massachusetts v. Environmental Protection Agency, 549 U.S. 497 (2007)) · representation of a client in a liability risk transfer agreement dealing with the cleanup at a Superfund site that is expected to have remediation costs in excess of $40 million In an ongoing matter, Mr. Davis represents an economic development entity and a memorial foundation in conjunction with the World Trade Center site. He also represents clients in "smart growth" redevelopment efforts in the District of Columbia and in Lower Manhattan. Activities Mr. Davis is a member of the Environmental Advisory Committee. The committee was created in 2007 to assist Maryland's attorney general in identifying priority environmental issues and to help guide environmental policy and enforcement initiatives. Mr. Davis has provided pro bono assistance to former Environmental Protection Agency Administrators, the Urban Land Institute, the District of Columbia and to children removed from the care of their parents by the state.
