Representative Experience Represented large national bank in numerous commercial matters involving various types of depositor accounts, trusts, mortgages and foreclosure actions. Represented national healthcare company in commercial and tort matters, including claims of vicarious liability in medical malpractice actions. Upheld enforceability of limitation of liability clause in case affirming the grant of summary judgment in favor of client in Flanigan v. Executive Office Centers, Inc., 249 Ga. App. 14; 546 S.E.2d 559 (2001). Represented large financial entities in consumer class action lawsuits alleging violations of Fair Credit Reporting Act. Obtained dismissal of action alleging breach of contract and business torts against Georgia Power Company in On-Site Fuel Service, Inc. v. Georgia Power Company, CA No. 3:01CV103BN (S.D. Miss. 2001). Represented First Union Corporation in securities actions brought by SunTrust Bank and shareholder class action actions challenging the merger between First Union Corporation and Wachovia Corporation.
