Michael McFadden has extensive experience in trade union litigation before the Ontario Labour Relations Board, the Canada Industrial Relations Board, boards of arbitration, human rights boards of inquiry and other employment-related administrative tribunals. He also has significant advocacy experience in individual employment law litigation. This diverse experience has provided opportunities to represent a wide variety of clients in essentially all sectors of the economy.
Mr. McFadden often participates in the employment and labour law aspects of complex business transactions, including mergers and acquisitions and business restructurings, both for privately and publicly held companies. He prepares executive employment agreements, negotiates and finalizes employment covenants and indemnities in agreements of purchase and sale, advises on and drafts bonus and/or option plans and supervises due diligence processes.
Since joining the firm, Mr. McFadden has practised employment and labour law exclusively on behalf of employers. He brings a unique and invaluable perspective and insight to management-side representation having previously practised exclusively on behalf of trade unions.
