In its April 1, 2009, decision in 14 Penn Plaza LLC v. Pyett, the Supreme Court has resolved, in a 5-4 vote, a question that has stymied employers for years, by holding that an arbitration clause in a collective bargaining agreement may be enforced against individual age discrimination claimants.
