Monique is a commercial litigator with experience representing corporations, real estate developers, and some of the nation's largest insurance companies in disputes involving commercial contracts, employment matters, business torts, and insurance coverage issues.
With respect to general commercial matters, Monique has successfully litigated breach of contract, fraud, trademark infringement, and professional liability suits in federal and state courts throughout the United States.
Monique has successfully represented both employers and employees in a variety of employment-related matters, including matters involving allegations of wrongful termination, harassment, and violation of public policy.
Monique has significant experience litigating complex insurance coverage issues, including directors and officers and professional liability matters. In addition, she has defended several insurance companies against claims of bad faith.
Additionally, Monique has handled pro bono matters with the ACLU and the Orange County Public Law Center.
Representative Experience
Currently representing Vietnamese state-owned company in arbitration pending in Singapore involving contractual dispute in excess of $10 million.
Currently representing nationally-recognized company that provides vehicle history reports in connection with several contractual disputes.
Represented surfware trademark owner of Rusty brand in a dispute over the termination of a worldwide License Agreement.
Obtained injunction to prevent former employees from stealing trade secrets from a large-scale electrical supply company.
Achieved favorable outcome for sales industry veteran alleging breach of contract against competitor company who induced him to leave his long-time employer.
In a pro bono case, succeeded in obtaining COBRA benefits for a former employee who was denied benefits from a large telecommunications company.
Represented 30-year university employee alleging discrimination and retaliatory conduct.
Obtained summary judgment and case dismissal in a complex coverage litigation matter in the Northern District of California.
Obtained summary judgment in coverage/bad faith lawsuit where court enforced the policy's pending and prior litigation exclusion.
