The United Kingdom's Information Commissioner's Office ("ICO") has released new guidance on the disclosure of employee data during a takeover or transfer of a business or where there is a "service provision change" (e.g., an outsourcing, re-sourcing or in-sourcing).

Data Breach Notification: Debate in the EU

In the wake of a number of security incidents in the United Kingdom and elsewhere, the debate has reopened as to whether there should be a US-style security breach notification law, requiring those suffering a data breach to notify individuals, as well as national data protection authorities.

It has been nearly three years since the UK Information and Consultation of Employees Regulations 2004 (the "Regulations") came into effect for organisations with 150 or more employees.
