David Schenberg is the Co-Chair of Ogletree's Appellate Practice Group. Mr. Schenberg regularly handles matters in state and federal appellate courts throughout the United States, and has litigated two cases ultimately decided by the United States Supreme Court. Mr. Schenberg has had primary responsibility for federal appellate matters in the First, Sixth, Seventh, Eighth, Ninth and Tenth Circuits and for state appellate matters in the Eastern, Southern and Western Divisions of the Missouri Court of Appeals. Mr. Schenberg has presented oral argument before the United States Courts of Appeals for the Seventh and Eighth Circuits, the Eastern and Western Divisions of the Missouri Court of Appeals, and numerous federal district courts.Mr. Schenberg also specializes in defending business clients against high-stakes class and collective actions. The subject matter of these complex litigation matters include alleged violations of state and federal wage and hour laws, state and federal discrimination laws, and federal employee benefits laws. Mr. Schenberg's work on these and other litigation matters includes defending well-known national and international companies engaged in industries such as manufacturing, healthcare, telecommunications, hospitality, retailing, entertainment, gaming, mining, and insurance. In addition to his complex litigation and appellate law practices, Mr. Schenberg regularly advises and defends clients, large and small, in all areas of employment law, including race, age, gender, and disability discrimination, sexual and other harassment, workers' compensation retaliation, wage and hour, employee leave, background checks, contracts, handbooks, and restrictive covenants. Prior to joining Ogletree, Mr. Schenberg was a partner at a large firm based in St. Louis and Kansas City.
