| Biography | Adela Estopinan started her law career as a Miami-Dade prosecutor, serving as an Assistant State Attorney in the Eleventh Judicial Circuit. For the past four years, she has been an adjunct faculty member at University of Miami. Ms. Estopinan also manages the South Florida regional hub of Legal Helpers, a major national bankruptcy law firm, overseeing operations in three counties. She is admitted to the Florida bar and the U.S. District Court for the Southern District of Florida, as well as being a member of the Bankruptcy Bar. | Transactions | Ms. Estopinan, as managing attorney of Legal Helpers in Miami, successfully enforced a bankruptcy stay as of July 2, 2009, against a creditor and its attorney, for failing to cease wage deductions following the filing of a Chapter 13 bankruptcy. This case has recently been made a published decision, Westlaw case #2009 WL 3378495 (Bkrtcy. S.D. Fla). The creditor in the case continued to garnish the paycheck of a Chapter 13 personal bankruptcy Legal Helper's client, post-bankruptcy filing, which is in violation of federal law. The attorney for the creditor, relying on a decision in a similar case, refused to stop the garnishment. Ms. Estopinan filed an Emergency Motion, effectively forcing the creditor to return all funds seized and to impose sanctions. Following extensive legal research, two contentious court hearings and the submission of a detailed memo of law, the Legal Helpers lawyer prevailed. Case No.:10-03640 A family law attorney opened an adversarial case against a Legal Helper's client in Miami, contesting the dischargeability of attorney fee's in a child custody case. Ms. Estopinan answered the adversarial, appeared in court on behalf of the client, succeeded in having the adversarial case dismissed and recouped attorney fees for the debtor. |
