Neal Bailen is an Associate in the firm's Indiana office. His practice focuses on civil litigation, residential mortgage litigation and health care law. He defends numerous professionals--including lawyers, insurance agents and brokers, debt collectors, and title agents--in professional malpractice suits throughout Indiana and Kentucky. He regularly represents banks and lenders in mortgage litigation, including lender liability actions and contested foreclosures. He has been named as a Rising Star in the field of business litigation by Indiana Super Lawyers.
•Lead counsel in successful dismissal of borrower's attempt to set aside foreclosure judgment and bring new claims based upon allegations that lender did not have authority to enforce a promissory note and robo-signed a false affidavit.
•Obtained summary judgment in favor of national manufacturer sued for negligence by an employee of an independent contractor who was injured while performing maintenance at a production plant. Smith v. Daramic, LLC, 2013 U.S. Dist. LEXIS 88638 (S.D. Ind. June 25, 2013).
•Lead appellate counsel in successful appeal of quiet title judgment that usurped priority of first mortgage lien. Countrywide Home Loans, Inc. v. Holland, 993 N.E.2d 184, 186 (Ind. Ct. App. 2013).
•Local counsel in successful defense of qui tam action asserted in state court against national lenders involving the recording of mortgage assignments.
•Lead counsel in successful dismissal of common law claims asserted against national mortgage lender. LeForge v. BAC Home Loans Servicing, L.P., 2011 U.S. Dist. LEXIS 43477 (S.D. Ind. Apr. 21, 2011).
