Nicolai focuses his practice on aviation and commercial litigation matters. As a member of the firm's Aviation Litigation Practice Group, Nick regularly represents aircraft operators and owners, component manufacturers, airlines and airports. He also devotes a significant portion of his practice to various complex litigation matters, including business disputes, interpretation of contracts and insurance policies, product liability matters and construction defect litigation. Additionally, he has handled numerous general liability cases.
Nicolai previously worked within the Professional Liability and Technology, Media, and Data Security Practice Groups of the firm, where he handled cases ranging from defending various professionals in malpractice actions to advising entities regarding state and federal data privacy laws. He gained unique experience assisting clients in responding to data breaches, including issuing individual notifications pursuant to state and federal law, corresponding with state Attorneys General and establishing identity theft prevention programs.
He is currently admitted to practice in Pennsylvania and New Jersey.

|Reported Cases||Significant Representative Matters; Obtained award in favor of client, a helicopter repair station, at arbitration before the International Chamber of Commerce in case involving a commerical dispute with a forein helicopter operator, and collected on arbitration award by pursuit of operator in its home country. Received defense decision in favor of client, a government entity owning an airport, at arbitration of a premises liability claim involving alleged traumatic brain injuries. Represented defendant attorney in a case involving an alleged misappropriation of estate assets, and obtained a dismissal with prejudice of all claims through dispositive motion practice. Obtained dismissal of all claims against client, an entity with an attenuated ownership interest in an apartment building, in a case involving the death of a communications contractor who fell to his death while installing equipment on the roof of the apartment building. Successfully confessed judgment against an entity that defaulted on settlement obligations to client, a Part 135 operator under the Federal Aviation Regulations, and pursued the defaulting entity to a successful resolution in case involving breach of contract arising out of charter flight services provided by client.|
