Practice/Industry Group Overview
The firm’s real estate group handles a broad range of matters.
We represent financial institutions and other lenders in various types of real estate financings throughout the United States, including large multi-property financings of properties located in multiple jurisdictions. Our services start with initial due diligence and continue through document preparation and negotiation, title and survey review and closing.
Loan Workouts and Restructurings
Our lawyers have extensive experience in the representation of lenders in real estate loan workouts and restructurings. Our engagements have involved the negotiation of pre-workout and workout agreements, leading to the restructuring of existing loans, or, where necessary, to the representation of lenders in foreclosures, deeds in lieu of foreclosure and bankruptcies.
The firm’s real estate group represents both landlords and tenants in the leasing of all property types, including leases, subleases and assignments of leases for office, retail, industrial and warehouse properties and related work letters, electric inclusion agreements and subordination and non-disturbance agreements.
Acquisitions and Sales
We advise purchasers and sellers of all types of property throughout the United States. Our clients benefit from our extensive knowledge of survey issues, title exceptions and insurance requirements nationwide.
The firm represents owners in negotiating architect’s agreements, construction contracts and related agreements.
We handle environmental matters affecting the acquisition, disposition, financing and leasing of real estate, including reviews of environmental audits.
Real Estate Litigation
Real estate litigation is a highly specialized field requiring an in-depth understanding of the often-complex provisions of local real estate laws. Our experience in this arena gives us the ability to take the steps necessary to litigate real estate matters successfully, and provide advice to avoid the pitfalls that may prevent a client from successfully protecting its position or pursuing its remedies in a real estate dispute.
