On February 27, 2009, CMS published an interim final rule with comment period extending the timeline for publication of a final rule concerning changes to Medicare claims appeal procedures (74 Fed. Reg. 8867). The final rule will now be published by March 1, 2010.

Federal Officials Set to Increase Investigations into Illegal Kickbacks to Doctors from Drug and Device Companies

An article published in the New York Times on March 4, 2009, states that Federal prosecutors are increasing investigations into doctors who take illegal kickbacks from drug and device companies.

Texas Department of Insurance ("TDI") Adopts Rules Concerning Continuing Care Retirement Centers ("CCRCs")

On March 6, 2009, TDI published an adopted rule in the Texas Register (34 Tex. Reg. 1608) concerning CCRCs. Under the adopted rule, providers operating a phase-in facility may make an initial filing with the escrow agent, then with TDI, and then supplement the filing with quarterly reports.
