Mr. Kennison is a litigation partner in the Omaha office. He has represented the interests of insurers and reinsurers in insurance coverage matters in virtually every state for more than 25 years. Mr. Kennison focuses his practice on potentially catastrophic claims, including professional liability matters involving lawyers, accountants, architects and engineers, products liability, environmental cleanup, and officers' and directors' liability. He has a strong background in alternative dispute resolutions and frequently negotiates multiparty claims and coverage disputes. He provides coverage analyses and opinions for corporations and insurers in various insurance-related matters. He also represents clients in insurance litigation, including declaratory judgment actions, bad-faith suits, subrogation actions and disputes among insurers. Mr. Kennison also has appearedpro hacin numerous courts across the nation. He also supervises and manages claims and coverage litigation in federal and state courts throughout the United States. In addition, Mr. Kennison acts as general counsel to the firm.
Recently, Mr. Kennison represented an insurer and obtained a declaratory judgment that false billing claims made by the government against the insured under the False Claims Act were not covered, and there was no duty to defend or indemnify.See, Zurich American Ins. Co. v. O'Hara Regional Center for Rehabilitation, 529 F.3d 916 (10th Cir. 2008). Subsequently, in that case, Mr. Kennison successfully obtained a judgment entitling the insurer to recoup all of its defense costs which it had paid while defending the underlying action under a reservation of rights.See, Valley Forge Ins. and Zurich American Ins. Co. v. Health Care Management Partners, 616 F.3d 1086 (10th Cir. 2010).
