Biography

Paul has significant experience in all facets of land development including complex mixed-use redevelopment; Developments of Regional Impact (DRIs); land use plan amendments; platting, zoning and site plan approvals; variances; and land use due diligence. He also regularly assists property owners in code enforcement matters. Paul is also a licensed California General Contractor and has prior experience as a builder.

As the first LEED Accredited Professional (LEED® AP) attorney in Florida and fifth in the United States, Paul was at the forefront of attorneys who recognized the significance of sustainability and green building trends on all aspects of real estate development, operations, and business in general and responded by receiving accreditation through the U.S. Green Building Council and focusing a significant portion of his practice on sustainable development. He is actively assisting clients in a variety of green building and sustainability initiatives.

Real Estate Development

· Represents developers and institutional property owners in land use, zoning, platting, site plan and variance matters before local government agencies, with an emphasis on complex mixed use redevelopment

· Prepares and processes Applications for Approval of Developments of Regional Impact (DRIs) and DRI development order amendments; secures DRI binding letters from the state; prepares and implements DRI avoidance strategies

· Conducts comprehensive land use due diligence and redevelopment analyses

Sustainability

· Represents developers of sustainable development/ green building projects on entitlement, incentives, project governance, leasing, financing, design and construction contracting, insurance and certification issues

· Counsels property owners on insurance issues for green building projects

· Prepares commercial leases for landlords and tenants for buildings seeking green building certification

· Counsels design, engineering and consulting professionals on contractual and risk management issues pertaining to green building projects

· Represents local governments and developers seeking to deploy innovative energy efficiency and carbon reduction strategies in their communities including municipal clean energy financing programs

Significant Redevelopment Representations

· Land use entitlements for the redevelopment of Fashion Mall with mixed use town center including office, retail and residential in Plantation, Florida.

· Land use entitlements for the redevelopment of the Fountains Shoppes of Distinction with mixed use including 472 residences in Plantation, Florida.

· Land use entitlements for the redevelopment of the $800M Diplomat Resort, Country Club and Spa in Hollywood and Hallandale Beach, Florida.

· Land use entitlements for the redevelopment of the 193-acre Munisport landfill property as a mixed use project with 6,000 residential units in North Miami, Florida.

· Land use entitlements for the redevelopment of the 56-acre Buena Vista rail yard as a mixed use project with 4,500 residential units and 600,000 square feet of commercial use in Miami, Florida.

Significant Representations in Sustainable Development

· Served as sustainability counsel for two large scale mixed use LEED for Neighborhood Development Pilot Projects including Retail, Office and Residential uses, assisting with project entitlements, preparation of Demolition and Waste Management Plan, construction contract for LEED office building renovation, Tenant Design Guidelines for Sustainable Development for LEED Core & Shell office building; and Master Declarations.

· Preparation of Development Agreement and entitlement assistance for 2,500 unit mixed use model "green" community in California for developer/homebuilder.

· Preparation of Offsite Habitat Mitigation Agreement for proposed LEED office building in Colorado for office REIT.

· Preparation of office lease for European pension fund landlord for full floor tenant going into office building proposed for LEED Existing Building retrofit in Florida.

· Drafting of "green" provisions in lease for build-to-suit for international property owner/developer for proposed 1 million square foot LEED building in Georgia.

· Conduct A&E contract audit and risk management assessment for international A&E firm for proposed military LEED building in Florida.

· Preparation of form service contracts for LEED consulting and building commissioning services for consultant.

· Preparation of professional liability insurance audit and advice for LEED consultant.

· Preparation of "green" provisions in design contract for Fortune 500 company for proposed LEED company headquarters building in New York.

· Conduct comprehensive project entitlement document audit and prepare green building issue and risk assessment for mixed use California project for global aircraft manufacturer.

· Participation in creation of corporate green supply chain initiative for global financial institution.

· Preparation of model green building ordinance for national industrial and office trade association.

· Preparation of lease for landlord for proposed LEED for New Construction certified office building.

· Preparation of green building provisions for build-to-suit agreement for life science facility for University.
