Biography

Paul Davidson is a partner at Waller Lansden and serves as Chair of the firm's Healthcare Litigation Practice. He is a trial attorney and has devoted 30 years to complex civil litigation in jurisdictions throughout the Southeast as well as in Washington, D.C., California, Utah and New York. Mr. Davidson has been recognized for 10 years in The Best Lawyers in America and is recognized by Chambers USA for his work in the areas of antitrust law and commercial litigation.

Mr. Davidson's clients include corporations, healthcare providers, and individual corporate officers and directors in regulatory, investigative, arbitration, and trial matters. These representations have involved antitrust, securities, intellectual property and other complex commercial disputes involving extensive e-discovery, attorney-client privilege and fiduciary duty and conflicts of interest issues.

Mr. Davidson speaks extensively at professional conferences and seminars, where he shares his experience in managing e-discovery and litigation costs, issues involved in deposing witnesses, alternative dispute resolution and other topics. Additionally, he is a member of the Sedona Conference Working Group on Electronic Document Retention and Production.

Among his recent successes, Mr. Davidson served as co-lead trial counsel in a case against Jefferson County, Alabama where his Trustee client won a $515 million judgment and the appointment of a Receiver to take over control of the County's sewer system. He also recently won a major victory for a nonprofit healthcare foundation in a complex fraud and breach of fiduciary duty case in federal bankruptcy court. Mr. Davidson's prosecution of the case, in collaboration with the Tennessee Attorney General, resulted in the foundation's recovery of nearly $44 million for the benefit of Tennesseans in need.

Other significant representations include:

· Successful defense of nation's leading pharmaceutical benefits management company in derivative and putative class action lawsuits alleging the backdating of stock options.

· Lead trial counsel for the nation's largest provider of healthcare auditing services in the successful prosecution of complex trade secret and unfair competition litigation.

· Lead trial counsel for the nation's largest healthcare provider in numerous matters, including indemnification claims for False Claims Act damages paid in qui tam litigation.

· Lead trial counsel for a national Managed Care Organization in numerous matters, including class action and related litigation involving TennCare, Tennessee's managed healthcare program.

· Counsel for a national accounting firm in internal investigations and in numerous litigated matters, including the successful defense of a class action involving a publicly held healthcare company.

· Lead trial counsel in the defense and prosecution of antitrust litigation in federal courts and before the Federal Trade Commission involving claims of exclusive dealing, unlawful tying, refusal to deal, and the use of intellectual property to eliminate competition.
