The focus of his practice is energy law and the representation of energy firms in proceedings before the Federal Energy Regulatory Commission (FERC), state regulatory agencies and the federal courts. Peter began his career as a trial lawyer at the Federal Power Commission and its successor agency, FERC. From 1977 to 1979, he served as legal advisor to FERC Commissioners Matthew Holden (pro tem) and Georgiana Sheldon. Since entering private practice in 1979, Peter has successfully represented electric utilities, marketers and independent power producers, hydroelectric owners and developers, petroleum products and natural gas pipelines, local natural gas distribution companies, and an industry-sponsored research and development organization in numerous regulatory and appellate proceedings. His career has spanned the restructuring of the interstate natural gas pipeline and electric utility industries under the FERC's many rulemaking and policy initiatives. He is also experienced with matters concerning implementation of congressional energy policy as embodied most recently in such legislation as the Energy Policy Act of 2005 and the Energy Independence and Security Act of 2007. Peter is admitted to practice before the courts of Michigan and the District of Columbia, the U.S. District Court for the District of Columbia, the U.S. Courts of Appeals for the Third, Fourth, Fifth, Tenth, and District of Columbia Circuits, and the U.S. Supreme Court. REPRESENTATIVE MATTERS: Advise and represent electric utilities, marketers and developers in matters relating to regulated rates and services, including open access transmission tariff issues, market-based rate authorizations, standards of conduct compliance, exempt wholesale generator determinations, purchase and sale of jurisdictional assets, audit and fuel procurement reviews, rulemakings, contract preparation and negotiation, and industry restructuring generally. Advise and represent local natural gas distribution companies in interstate pipeline tariff, certificate, abandonment and rulemaking compliance proceedings, as well as in matters involving direct FERC regulation of client services, by-pass, supply procurement, facilities acquisition, asset portfolio management and jurisdictional determinations. Advise and represent interstate natural gas pipelines in proceedings involving pipeline rates and services, certificates of public convenience and necessity, abandonment of facilities and services, rulemaking compliance, jurisdictional determinations and enforcement. Advise and represent hydroelectric owners and developers in exemption, preliminary permit, and licensing proceedings, jurisdictional determinations, dam safety and headwater benefits determinations, and enforcement matters.
