Clean Technologies and Renewable Energy

Energy supply and demand is increasingly important to national, state and local policy and legislative programs which in turn affects all business interests. Procopio works with clients on some of the most innovative renewable energy and resource efficiency technologies and projects including wind, solar, geothermal, electric motors, alternative fuels, carbon emissions reduction, energy demand and efficiency, monitoring and water management systems.

We recognize the significant economic and human resource demands associated with energy consumption and the opportunities for clean technology and renewable energy companies to address these challenges. We assist our clients in all stages of development and operations from obtaining financing through venture capital, private equity and governmental sources, securing necessary operating licenses and permits, land use entitlements and lease negotiations, forming corporate governance and securities reporting requirements, protecting intellectual property and innovative technology, employment relations, taking advantage of tax credits, deductions and other incentives, and by advising on existing and proposed legislation and regulations to maintain the competitive advantage.

Climate and Sustainability

Sustainability and environmentally-friendly business practices are rapidly becoming a requirement for businesses and individuals. As concerns about global energy supply and climate change increase, those who adopt sustainable practices will be better positioned to survive in a changing environment and to take advantage of new business opportunities regarding renewable resources while preserving our natural capital.

In addition to Procopio’s project financing and development services, we help our clients and the community to understand emerging environmental statutory and regulatory requirements including air permitting, carbon programs such as cap-and-trade, cap-and-dividend, and carbon credits, SEC disclosure obligations and compliance with California Environmental Quality Act (CEQA) for greenhouse gas emissions.

We advise clients in obtaining energy tax credits and other incentives, conducting environmental due diligence, procuring insurance for climate change risks and exposure, obtaining project permitting and securing LEED-certification for sustainable buildings, and serve the litigation needs of our clients in these areas.

Public Policy

Our attorneys continually track developments in the federal and state legislative arenas, and advise clients on the implementation of these developments, such as the American Recovery and Reinvestment Act of 2009, the American Clean Energy and Security Act of 2009, the California Global Warming Solutions Act of 2006 (Assembly Bill 32).

We advise clients concerning the implementation of legislative and regulatory initiatives that seek to achieve the AB 32 greenhouse gas emissions reduction goal, such as the Climate Change Scoping Plan, Senate Bill 375, the California Solar Initiative and the renewable portfolio standard, and provide practical information on the regulatory developments regarding climate awareness and change. Through our corporate partnership with Scripps Institution of Oceanography, we have a special appreciation for the science of climate change and that knowledge positions Procopio to better understand clients business needs.

Environmental Breakfast Club

For over 20 years, Procopio’s Environmental Breakfast Club (“EBC”) has offered the San Diego community a series of seminars addressing today’s key environmental issues.

Climate Club Dinner

The Procopio Climate Club is a periodic gathering of prominent business, political, technical, and policy leaders for the purpose of education and discussion on climate related issues.  Guests attend by invitation only.
