Richard Grossman focuses his practice on complex business litigation. His practice has frequently emphasized high-technology litigation matters, however, his clients include a wide variety of businesses and individuals with legal disputes covering a broad range of issues, including unfair competition, business fraud, antitrust, contract disputes, trade secret litigation, licensing disputes, class action litigation and intellectual property litigation. In addition, he has experience in a variety of alternative dispute resolution techniques including arbitration and mediation of commercial disputes. Client Milestones Cytec Antitrust Litigation. Counsel for global chemical products company in multi-million dollar antitrust and unfair competition lawsuits against a number of the client's suppliers that were accused of participating in a conspiracy to fix prices and restrain trade in the carbon fiber market. Result: Multiple confidential settlements in favor of client Microsoft Antitrust Class Action Litigation. Mr. Grossman was co-lead counsel for plaintiffs in a class action against Microsoft under California's antitrust and unfair competition statutes. The lawsuit was prosecuted on behalf of all California purchasers of Microsoft's personal computer operating system and applications software and alleged that Microsoft used its monopoly power to overcharge California businesses and consumers for its software products. Result: Settlement requiring Microsoft to pay $1.1 billion to the class and the bulk of any unclaimed funds to go to California public schools for the purchase of computer technology. Intergraph Corp. v. Intel Corp. Co-counsel for plaintiff in prosecuting antitrust, patent, contract and tort claims. Result: Intel paid client a total of $450 million. LMP Corporation v. Universal Manufacturing Corporation. Seven-month trial concerning fraudulent promise to commercially develop patented solid state lighting technology. Result: $96-million verdict in favor of clients; affirmed on appeal. Chevron USA, Inc. v. Digital Equipment Corporation. Lawsuit for $32 million in damages over the failure of a large systems integration project. Result: Very favorable confidential settlement for client. Zeny Computer Systems v. Acer Incorporated. Trial of $15.1 million claim against personal computer manufacturer client for misappropriation of trade secrets. Result: Verdict in favor of client on all claims at trial. Gracie v. Gracie. Jury trial of trademark and associated unfair competition claims against client. Result: Verdict in favor of clients on all claims against them and on client's trademark counterclaim for infringement of business logo. Bushnell v. Visual Information Service Corp. Defense of $30 million claim for a one-third interest in the stock of high technology client. Result: Summary judgment in favor of client.
