Robert A. Koenig practices in the areas of ERISA and employee benefits litigation, construction litigation, surety bond litigation and technology.
As lead litigation counsel, Rob represents plans, boards of trustees, sponsors, employers and third-party administrators in all phases of ERISA and employee benefits litigation. He serves as counsel in litigation matters for numerous local, Ohio and national plans. He defends breach of fiduciary duty claims, class action suits asserting ERISA claims, and denial of benefits brought by individual participants. He has extensive practice experience before U.S. District and Bankruptcy courts.
Rob has extensive experience in all phases of commercial, construction, and surety bond litigation. He also regularly represents owners, contractors, subcontractors, materials providers, surety companies in various litigation matters. He has substantial experience in the preparation and presentation of construction claims in arbitrations under the AAA Construction Industry Arbitration Rules.
Rob assists software developers, digital agencies, website designers and media promoters with protecting their new technologies, ideas, and inventions through aggressive licensing provisions in all of their agreements. Also, he routinely advises on technology development agreements that protect the purchasing party's goals and clearly articulate the critical deliverables, testing, deployment, acceptance and support phases of the project.
Prior to joining the firm in 1985, Rob served for two years as Law Clerk to Hon. Nicholas J. Walinski, United States District Court, Northern District of Ohio, Western Division.
