Roetzel & Andress has extensive experience representing companies in the chemical industry, including formulators and producers; distributors and marketers; and purchasers and users of various additives, chemicals and chemical formulations for a variety of industrial products. Our attorneys also counsel fertilizer suppliers, plastics and rubber manufacturers, producers of powder coatings, and specialty chemical manufacturers. Representative Matters
- Represented a rubber chemicals manufacturer in a four-week jury trial in state court against trade secret and non-compete claims by a competitor
- Represented a distributor of chemical additives and negotiated a long-term distribution agreement granting them exclusive territorial rights
- Represented a manufacturer of products incorporating chemical compositions in negotiating and implementing strategic alliances with foreign entities, in order to distribute and sell jointly-developed products
- Represented a shared counsel group of chemical manufacturers against a former employee's family claim that exposure to toluene and xylene caused the employee's leukemia and death
- Represented a chemical manufacturing company before the Florida Department of Health regarding an alleged product violation
- Assisted a large industrial client with an emergency response effort associated regarding a chemical release from a tank at the client's facility. Defended various lawsuits that were filed as a result of the incident
- Represented a chemicals formulator in forming a joint venture entity and subsequently structuring joint product development and manufacturing agreements
- Represented a Fortune 250 chemical manufacturer in a wrongful death case in which an employee alleged that exposure to paints and other chemicals in the workplace caused an employee's decedent to contract nasopharyngeal cancer
- Represented a large industrial client against allegations that trichloroethylene (TCE) had contaminated a well field and a local school
- Represented a coatings company in litigation involving by-products and waste pollution from its operations
- Represented several large chemical manufacturers in a shared counsel group in a case involving exposure to 1,1,1 trichloroethane
- Represented eight chemical manufacturers in a vinyl chloride monomer exposure case in which a railroad worker claimed cancer as a result of exposure to various manufacturers' products in tanker railcars in rail yards
- Serve as national counsel in litigation in which the chemical, diacetyl, is alleged to cause bronchiolitis obliterans in microwave popcorn workers
- Represented a large local company in a suit involving exposure to halon gas alleged to cause permanent respiratory damage
- Represented a local company involving the dispersal of alleged toxic substances from a heating, ventilating, and air conditioning (HVAC) failure
