Roetzel & Andress' real estate attorneys represent owners, builders, contractors, commercial landlords, real estate investment trusts (REITs) and tenants in various types of commercial real estate transactions, including retail, office, multifamily residential and industrial real estate acquisitions, financing, leasing, development, construction, management and dispositions. Our attorneys also represent financial institutions, investors, borrowers, lenders, and entrepreneurial individuals to institutional investors and lenders. They also represent institutional investment consultants in the preparation and negotiation of loan documentation, loan participations, inter-creditor agreements, and securitized loan transactions.

Representative Matters

  • Represented a national home builder in winning unanimous approval and transportation concurrency vesting for a 2,500 acre mixed-use Development of Regional Impact community, with 3,250 residential units and 200,000 square feet of commercial space
  • Organized and represented a coalition of environmental and development interests in earning unanimous approval of a comprehensive plan amendment. This quadrupled the number of potential Transfer of Development Rights (TDR) residential units, and were incentives for increased environmental stewardship and government conveyance
  • Prepared documents and coordinated filings with the Division of Florida Land Sales for condominium, high-rise hotel condominium, and residential condominium developments throughout southwest Florida
  • Represented a client in the sale, land use, and title insurance work for two 20-screen multiplex theatre sites throughout Florida
  • Represented several grocery store anchored shopping centers in the acquisition, development, land use, zoning, leasing, construction, financing, and outparcel sales in various locations throughout Florida
  • Provided negotiations, closing and title insurance work for hotels, motels, golf courses, and shopping malls throughout Florida
  • Represented a client in the acquisition of shopping center in southwest Florida
  • Negotiated purchase contract for hotel acquisition on Marco Island, Florida
  • Represented a client in zoning and development work for a high-end, multi-phase, residential subdivision in southwest Florida
  • Provided counsel for the site acquisition and development of an industrial park
  • Provided counsel for the acquisition, construction, and sale of 100+ bank facilities
  • Provided counsel for the acquisition and infrastructure loan for a marina and property, which was the largest sale in the history of Cape Coral, Florida
  • Negotiated the purchase, including transaction closing and lease work, of rental properties in southwest Florida
  • Formed real estate limited liability companies or limited partnerships for use by foreign nationals in investment in U.S. real estate
