Rose Marie L. Fiore is an experienced commercial litigator and trial attorney, practicing in the firm's Cleveland office. She has successfully briefed and argued cases in many Ohio appellate districts and in the United States Court of Appeals for the Sixth Circuit.
On behalf of lending and financial services clients, Rose Marie has successfully litigated disputes concerning loan origination, forced-placed insurance, contested foreclosures, loan servicing, alleged unfair or deceptive trade practices and credit reporting. She routinely defends against common law claims and claims arising under Ohio's Uniform Commercial Code and Consumer Sales Practices Act, as well as alleged violations of TILA, RESPA, FDCPA, RICO, and FCRA.
Rose Marie also represents clients in the auto finance industry, including defense of claims under the FTC Holder Rule, notice requirements, repossession and collection issues, floor plan and warehouse lending, add-on services and products, indemnification and repurchase requests, and defense of individual and putative class action claims.
In the franchise industry, Rose Marie has successfully litigated disputes regarding trademark infringement, breach of license agreements, and vicarious liability claims. She also has obtained preliminary injunctions and temporary restraining orders on behalf of franchisor clients.
