Biography

Sarah Cooleybeck, a partner in the firm's Intellectual Property Department, has over fifteen years of experience providing patent litigation and counseling services in the life sciences industry.

Sarah offers legal advice regarding patent infringement disputes, U.S. and international patent strategy, patent licensing, and Hatch-Waxman and related FDA matters. Drawing on her extensive experience in the resolution of patent-related disputes, she helps life sciences companies meet their business goals while navigating patent and regulatory requirements.

Sarah's in-depth patent infringement litigation and related counseling expertise is complemented by her experience handling trade dress and trade secret claims, International Trade Commission investigations, Federal Circuit and First Circuit appeals, and environmental liability claims, as well as a wide range of pro bono matters.

· Hatch-Waxman patent infringement and antitrust litigation on behalf of innovator company against generic drug companies regarding patented therapeutic drug for end-stage renal disease.

· Defense of damages claims against major medical device company in patent infringement litigation relating to automated molecular diagnostic instruments.

· Mediation of intellectual property dispute between Central American indigenous group and multinational corporation relating to sourcing of cosmetic products.

· Consultations with start-up, midsized and global biotechnology companies regarding U.S. and foreign patent strategies, research exemptions and licensing disputes.

· Trial of patent infringement and antitrust claims involving automated diagnostic testing instruments.

· Federal Circuit and Supreme Court amicus briefs on behalf of multiple pharmaceutical companies.

· First Circuit appeal of multi-district litigation concerning consumer protection claims against major pharmaceutical company relating to Medicare reimbursement.

· Trial of inequitable conduct claim and defense of patent damages claim in patent infringement litigation involving biodegradable polymers used for drug delivery.

· Litigation of damages claim and First Circuit appeal in patent licensing dispute between Canadian company and academic teaching hospital involving research into the treatment of eye disease using photosensitive drugs.
