Biography

Shane Hardy's extensive trade-mark practice has seen him act as counsel to a wide range of Canadian and international intellectual property (“IP”) rights holders and has allowed him to assist in the protection and enforcement of some of the world's most famous trade-marks. Shane is recognized as a leading lawyer by the World Trademark Review (WTR1000): The World's Leading Trademark Professionals for his work on both prosecution and enforcement matters. WTR writes in their 2014 edition that Shane is “proactive and down to earth in his approach”. He “is considering the client's business and brand strategically, which positions companies well for any future disputes or issues they may encounter.” Sources affirm that Shane is “a rising star of Canadian trade-mark law.” Shane was also previously selected as a finalist for the Lexpert Rising Stars: Leading Lawyers Under 40 awards.

Shane's IP practice also involves the protection and enforcement of copyrights, patents, sound marks and trade secrets; in addition, he is often called upon to act as IP counsel in respect of business transactions and financings.

Shane's experience includes:

•Managing international trade-mark portfolios on behalf of some of Canada's most successful brands
•Prosecuting trade-mark applications as a Registered Trade-mark Agent
•Acting for clients in respect of trade-mark oppositions and cancellation proceedings
•Providing opinions to domestic and international clients on trade-mark availability and registrability
•Conducting litigation risk and strategy opinions
•Enforcing and licensing intellectual property rights on behalf of well known international retailers, educational service providers, colleges and universities
•Acting as litigation counsel in confidential information, copyright, trade-mark and patent actions in the Ontario and Federal Courts

Shane is an active leader within the Canadian IP Community. He has been a member of the International Trademark Association (“INTA”) Enforcement Committee and is a member of the INTA Non-traditional Mark Committee (Canada Subcommittee). Shane's leading involvement in sound marks resulted in him being invited to present to the Association of Corporate Counsel's 2013 Annual Meeting where he chaired a panel of experts from the United States and Europe on non-traditional trademark issues. Also in 2013, Shane was profiled as a Litigation Lawyer to Watch for his IP work in the Lexpert Guide to the Leading US/Canada Cross-Border Litigation Lawyers in Canada.

Shane is also active in Canada's legal education community and has, for several years, coached the Osgoode Hall Law School team in Canada's Fox Moot (Canada's national intellectual property moot). In 2013 he presented at the University of Toronto's Faculty of Law at a session entitled 'Protecting Roots,' designed to chronicle protection strategies for one of Canada's most famous brands.
