Biography

Stephen Zweig's practice covers multiple areas of employment, labor, and benefits law, including executive compensation, contract, non-compete, and wage and hour litigation, collective bargaining negotiations, and representation of labor-management funds.

For companies as well as senior executives, Stephen negotiates all types of employment, separation, change-in-control, consulting, and independent contractor agreements. He derives his negotiating strategies and tactics from over 35 years' experience resolving employment and labor-management disputes. He is a contributing author for Lexis Practice Advisor on separation agreement negotiations. Stephen also drafts non-qualified deferred compensation plans, equity and quasi-equity plans, earn-out arrangements, and all types of short and long-term incentive plans.

Stephen litigates breach of contract, non-compete, employment discrimination, and wage and hour claims in federal and state courts.

Stephen's traditional labor law practice covers many industries, most notably healthcare, where he represents both non-union and union employers. He has represented major medical centers and hospitals, nursing homes, long-term care facilities, registries, and home care agencies. He is a lead negotiator in multi-employer negotiations in the home care industry. He serves as management co-counsel on health, pension, and education labor-management funds.

Stephen has represented international investment and commercial banks, hedge funds, broker dealers, law, accounting, insurance and consulting firms, and companies engaged in various other industries, including electronics and computer, construction and real estate, hospitality and food service, fashion and retail, hospital, nursing home and home care, staffing, security, shipping, stevedoring, and social services.

Recent Experience

•Multiple collective action wage and hour overtime lawsuits in the health care industry, resolved without any damages paid.
•Fiduciary breach lawsuits against Empire Blue Cross/Blue Shield, resolved with substantial settlements on behalf of Taft-Hartley health and welfare benefit funds.
•Employment contract and trade secret misappropriation lawsuits, each resolved in favor of the client.
•Discrimination lawsuits against Bankers Trust Company and National Westminster Bank, USA, dismissed after jury trial.

Executive Summary: The New York City Earned Sick Time Act ("the Act") goes into effect today, April 1, 2014. The Act requires employers with at least five employees who work at least 80 hours per year in NYC to provide all such employees with at least 40 hours of paid sick time per year.
