Biography

Stephen Zweig practices in multiple areas of labor, employment and benefits law, including executive compensation, litigation, collective bargaining negotiations, and the representation of labor-management funds.

For companies as well as senior executives, Stephen negotiates all types of employment agreements, including short and long form employment agreements, retention and consulting agreements, change-in-control agreements, separation agreements, and independent contractor agreements. He derives his negotiating strategies and tactics from over 35 years experience resolving employment and labor management disputes. Stephen focuses both on the substance and psychology of contract negotiations and partners with his clients, whether they wish him to be out-in-front in negotiations or behind the scenes. In his union labor negotiations, he represents multi-employer groups in coalition bargaining as well as single employers negotiating individual collective bargaining agreements. He also serves as management co-counsel on Taft-Hartley Funds.

As a litigator, Stephen litigates breach of contract, non-competition, non-solicitation and no-hire cases, misappropriation of trade secret and confidential information cases, employment discrimination cases, and class action, collective action, and individual wage and hour cases.

As an executive compensation lawyer, Stephen designs and drafts non-qualified deferred compensation plans, equity and quasi-equity plans, earn-out arrangements, and all types of short and long-term incentive plans.

Stephen has represented international investment and commercial banks, hedge funds, broker dealers, law, accounting, insurance and consulting firms, and companies engaged in all types of industries, including electronics and computer, construction and real estate, hospitality and food service, fashion and retail, hospital, nursing home and home care, staffing, security, shipping, stevedoring, and social service industries. In his work with senior executives, Stephen has successfully negotiated executive employment agreements, separation agreements and severance packages for CEOs and other high level executives in many different industries.

Recent Experience
•Discrimination lawsuits against Bankers Trust Company and National Westminster Bank, USA, dismissed after jury trial.
•Multiple collective action wage and hour overtime lawsuits in the health care industry, resolved without any damages paid.
•Fiduciary breach lawsuits against Empire Blue Cross/Blue Shield, resolved with substantial settlements on behalf of Taft-Hartley health and welfare benefit funds.
•Employment contract and trade secret misappropriation lawsuits, each resolved in favor of the client.
