Biography

Tanguy Le Gouellec de Schwarz is a partner in Goldberg Segalla's London office and is a member of the firm's Global Insurance Services Group. Tanguy is a dual-qualified lawyer (French and English law) who focuses on the resolution of insurance and reinsurance disputes, both in the UK and French courts, and also advises clients on insurance and reinsurance regulatory and commercial matters.

Tanguy has acted for clients across a wide range of industries, from aviation to financial institutions to energy. His degree in aerospace engineering proved invaluable when acting for aviation insurers with respect to litigation involving plane crashes, property damage, and reinsurance claims. Tanguy also represents clients concerning disputes related to product liability, financial institutions (FI), errors and omissions (E&O), and property/first-party insurance (including subrogation) at both the insurance and reinsurance levels. Further, he advises on coverage issues (both on English and French law) with respect to facultative and treaty reinsurance, product liability, E&O, FI, directors and officers (D&O), and property policies.

In the regulatory and commercial fields of insurance and reinsurance, Tanguy regularly advises clients concerning portfolio transfers, as well as cross-border discrete regulatory issues.

Tanguy has acted in the largest reinsurance litigation in France, and on numerous reinsurance arbitrations (both facultative and treaty). Tanguy also has experience in asbestos-related issues at both the insurance and reinsurance levels and is a member of the Insurance and Reinsurance Legacy Association.

Aviation Litigation

•Acting for and advising a large aircraft manufacturer following the collapse of its undercarriage (landing gear) and subsequent crash
•Acting for and advising aviation insurers with respect to various claims arising out of property damage at airports (airline services, parkings, roadway maintenance, etc.)
•Acting for and advising aviation insurers with respect to various claims arising out of damage to small aircrafts at local or regional airports
•Acting for and advising aviation reinsurers on coverage issues during a French arbitration against reinsureds
•Acting for and advising insurers of a French air carrier following the crash of one of its aircraft in the Red Sea

Reinsurance

•Acting for a captive of a large accounting firm in an arbitration against the captive's reinsurers
•Acting for a reinsured in a reinsurance treaty dispute concerning pension funds
•Advising and acting for insurers and reinsurers on applicable law and jurisdiction issues in relation to reinsurance policies and acting in relation to related English Court proceedings, including in the Court of Appeal

Product Liability

•Acting for the insurers of electronic goods on numerous claims alleging faulty goods
•Acting for insurers in a faulty designed recycling truck claim
•Advising insurers with respect to coverage issues arising out of faulty construction piles
•Acting for insurers with respect to a severe head injury claim arising out of a faulty horsebox trailer
•Advising insurers with respect to coverage issues arising out of a trampoline accident

• Tanguy spent 11 months on secondment to the legacy team of a major UK composite insurer, where he advised on the treatment of asbestos losses at both the direct and reinsurance levels

Professional Liability: Errors and Omissions

• Acting for E&O insurers (defendants) of French brokers (producing brokers) in relation to a US $500 million litigation in England
•Acting for E&O insurers (defendants) of English brokers in relation to the placement of a liability insurance cover for a series of Italian hospitals

Regulatory Work

•Advising a major composite insurer in relation to a potential Part VII transfer of a portfolio of French property and casualty business, including consideration of both the English and French regimes
•Advising English insurers concerning the removal of its French local representative
•Advising a large transport company concerning insurance regulatory and contractual requirements in the UK, France, Germany, and Belgium
•Carrying out extensive due diligence in portfolio transfer deals


Run-Off

•Acting for a major composite insurer in arbitration (claimant) claiming historical asbestos losses under numerous reinsurance contracts
•Advising on and drafting a suite of commutation agreements for a major UK composite insurer in relation to long-tail business, and advising generally on the potential recoverability from reinsurers
• Providing UK insurers with training on wordings-related issues, developments in relation to asbestos losses, and law and jurisdiction issues


Coverholders

•Acting for insurers involved in a binding authority granting the coverholder (a French broker) authority to bind them for construction risks
•Advising large UK composite insurer on various coverholder agreements

Cyber Risk and Social Media; E-Discovery; Records and Information Management

•Drafting an e-discovery protocol for an international insurance/reinsurance entity
•Carried out numerous e-discovery exercises during litigations and arbitrations

Fidelity Bonds and Financial Services Insurance

•Advising Bankers Blanket Bonds facultative reinsurers of an Afghan bank on coverage issues
•Advising insurers on coverage issues concerning claims issued in France by local governments against their insured bank
•Advising insurers on D&O coverage issues concerning a US claim where the policy is subject to French law
