| Biography | Tim is a trial lawyer in the firm's Boston office and a member in its Litigation Section. Since joining the firm in 1992, his practice has focused on the prosecution and defense of complex business disputes, national and international business arbitrations, claims involving breach of trust by business owners, partners, officers and directors, employment-related disputes, and various claims arising in and out of the bankruptcy context. Some of Tim's most recent cases include the following: · A two-day, fast-tracked arbitration in October 2010 between one of the firm's biotechnology clients and an international pharmaceutical company over rights and obligations under a collaborative development and license agreement, which, post-hearing, led to a high, eight-figure settlement offer for the firm's client. · The successful resolution in April 2009 of multiple lawsuits brought in late 2007 against our client, a leading national real estate developer, and several high level executives, resulting from a failed 200-unit development project. Succeeded in getting a bankruptcy proceeding dismissed, settlements with both the project's general contractor and real estate broker, and a settlement of litigation brought by the mezzanine lender, which had foreclosed on the project and sought over $20 million in recoveries on the guarantees. · A four-day ICC international arbitration in New York in January 2009 on behalf of a golf industry-based GPS electronic yardage manufacturer against former distributors and related parties located in Spain and the UK, which resulted in a $4.3 million award for the firm's client in July 2009. · The successful defense of a leading worldwide manufacturer and distributor of athletic footwear and apparel (and its parent company) in litigation threatened by its Taiwanese distributor in December 2007 as a result of the parent's acquisition of the subsidiary and the alleged damages that transaction allegedly caused to the distributor. In the face of a $23 million demand by the plaintiff, we were able to resolve the matter for just a fraction of the demand, a result very favorable to our client. · The successful mediation of a dispute in August 2008 with one of the world's leading financial management companies related to a series of warrant agreements that the company had acquired from the client's predecessor, which was further complicated through a spin-off of a lucrative division. · The successful recovery of more than $5 million for a worldwide oleochemical supplier in multiple suits, during 2007 and 2008, regarding contractual partners' non-payment for products. · A complete defense verdict in October 2007 for a U.S.-based medical device company in a multi-day AAA arbitration proceeding brought on by the claimant one year after it had purchased a product division from our client, and sought to unwind the transaction and obtain a refund of its purchase price. · A July 2006 victory in the Seventh Circuit Court of Appeals on behalf of bondholders holding $261 million of special facility airport revenue bonds, which United Airlines sought to avoid having to pay by having them recharacterized as disguised financing payments in its three-year-long bankruptcy reorganization. See United Air Lines, Inc. v. HSBC Bank USA, 453 F. 3d 463 (7th Cir. 2006), affirming 322 B.R. 347 (N.D. Ill. 2005). · A $2.2 million jury verdict awarded in May 2006 on behalf of an investment banking client who was improperly denied a fee after successfully securing a covered transaction for one of its own clients. · A multimillion-dollar settlement obtained on behalf of a U.S. medical devices company in a breach of contract arbitration proceeding in Geneva, Switzerland. · A multimillion-dollar settlement on behalf of a foreign client whose transit system tokens had been counterfeited by a Massachusetts entity. · The successful dismissal of all claims against former officers and directors of a bankrupt corporation whose bankruptcy trustee sought over $7 million in damages due to alleged fraudulent conveyances. Tim has represented numerous companies, senior officers, and shareholders in corporate control and separation disputes. He has represented a number of banks, institutional and individual investors, and fiduciaries in lawsuits and arbitrations throughout the country, involving claims of breach of fiduciary duty, business fraud, and diversion of corporate assets. He has litigated several fraudulent conveyance and preference actions (both in state court and bankruptcy court), and has been involved in a variety of disputes arising in major bankruptcies throughout the country. Tim also regularly represents a variety of companies in transactional, licensing, trade secret, and confidentiality disputes. From 1988 to 1992, Tim served as general counsel at Healthco International, Inc., a publicly traded company, which at the time was the world's largest distributor of dental equipment and supplies. At Healthco, Tim oversaw the legal aspects of the company's contractual arrangements, corporate and real estate transactions, labor issues, and insurance needs. He also directed the nationwide defense and prosecution of all litigation involving the company, including products liability and general liability claims. Tim capitalizes on his broad experiences as both outside and in-house counsel to understand his clients' goals and help them resolve disputes and achieve results in an efficient and cost-effective manner. In 2009, 2010, and 2011, he was recognized as a Massachusetts Super Lawyer, in a listing published as a special supplement to Boston Magazine. Tim is admitted to practice in all federal and state courts in Massachusetts. He is also a member of the American, Massachusetts, and Boston Bar Associations and has litigated cases in federal and state courts throughout the country, including Arizona, California, Connecticut, Delaware, Florida, Illinois, Maine, New York, Ohio, Washington,, .C., and Wisconsin. Tim has also arbitrated several international matters, including, atters heard in Boston, New York, Geneva, and Singapore. He received his B.A. from Williams College (1980) and his J.D., magna cum laude, from Boston University School of Law (1983), where he was an editor of the Law Review.
