Todd & Weld has extensive experience and expertise in the management of risk and the resolution of disputes in complex construction projects, both in the public and private sectors.  Representation has included owners, general contractors, design-build contractors, subcontractors, suppliers, and materialmen.

Our representation of owners has included developers of high-rise office buildings in the Boston area.  This representation focuses on managing owner-related issues such as negotiation of contracts, managing risk, resolving disputes that affect the owner’s interest such as liens and related actions, and litigation and arbitration concerning defective work and delay-related claims.  In addition, Todd & Weld has provided advice and litigation services to towns in connection with the development of waste-water treatment facilities and school projects.  We have also represented a major Boston area university in a lengthy arbitration relating to the construction of an athletic facility.  In addition, we have represented numerous private commercial and residential owners on a variety of construction-related matters.

Todd & Weld has also represented general contractors on public and private projects.  We have represented a joint venture in connection with the management of dispute resolution and successful negotiation of change orders on a significant section of the Big Dig Project.  We have also provided advice on a regular basis to a general contractor in connection with negotiations of contracts in excess of $200 million and also provided general risk management advice.  We are currently representing a group of contractors in connection with pending disputes relating to alleged leak issues in the Central Artery I-93 tunnel. 

Todd & Weld’s broad experience has also included prosecuting claims on behalf of general contractors and subcontractors.  In several instances, the claims or requests for equitable adjustments have sought tens of millions of dollars.  Such representation has included issues in mediation, dispute resolution boards, arbitration in several forums and litigation in various courts.  We have extensive experience with perfecting and prosecuting both lien and bond claims under applicable statutory authority.  We have had a high degree of success in securing payment for subcontractors and materialmen even in circumstances where the general contractor is experiencing financial difficulties.

Todd & Weld’s representative clients in the construction field include Jay Cashman, Inc., Modern Continental Construction Company, Suffolk Construction Company, The Congress Group, The Town of Holliston, and several single entity owners as well as the above-referenced university.  We also represent numerous small to mid-size subcontractors, equipment suppliers, and materialmen on a host of public and private projects.
