Tony Guerino II is a shareholder in the Energy Litigation section of the firm's Houston office. He has more than 25 years of experience in the energy industry and focuses his practice on complex commercial litigation and arbitration, including domestic and international oil and gas matters and energy related disputes.

Mr. Guerino routinely serves as lead counsel in energy litigation and arbitrations involving tens-of-millions to hundreds-of-millions of dollars, and has in-depth knowledge and hands-on experience in the energy industry. In addition to his proven courtroom and arbitration skills, Mr. Guerino is a petroleum and natural gas engineer who worked for a major exploration and production company, learning the technical and financial intricacies of the energy business prior to earning his law degree. This unique combination of engineering and legal skills, along with real-world oil and gas industry experience as an operations engineer, production engineer, reservoir engineer and positions with senior management responsible for onshore and offshore operations, makes Mr. Guerino one of Texas' go-to energy litigators.

Mr. Guerino consistently uses his strong technical knowledge of the energy industry to his client's advantage. For example, he represented an oil and gas operator against multimillion-dollar property contamination claims allegedly resulting from his client's oilfield operations. After discovery of technical flaws and issues in the plaintiff's claims, Mr. Guerino was instrumental in having the case dismissed. Similarly, his review of well logs in a case involving the loss of his client's prolific offshore well due to downhole tool failures, Mr. Guerino's technical background resulted in the addition of potential pay zones to his clients damage model - resulting in recovery of damages far in excess of his client's expectations.

Reported CasesSignificant Representations: Defended an independent oil & gas exploration and production company, and its officers, in breach of contract and fraud litigation involving overriding royalty interests in the Eagle Ford Shale and damages in excess of $700 million. Following resolution of complex litigation issues in his client's favor through pre-trial motions, the case was settled just before trial with Mr. Guerino's client recovering its legal fees from the claimant, and paying essentially no damages.; Represented international oil and gas E&P company in arbitration involving $300 million in damages related to title defects in oil and gas leases acquired in $2.5 billion transaction. A global settlement in favor of Mr. Guerino's client was entered by the parties.; Represent Anakara, Turkey based E&P company in international arbitration regarding ownership of exploratory licenses covering multiple exploratory blocks located in Turkey. The matter is still pending.; Defend domestic oil & gas E&P company against claims of ground and groundwater contamination allegedly related to onshore Louisiana wells drilled and operated by his client. The matter is still pending.; Represented refinery equipment owner and dismantler in federal court matter involving multimillion-dollar damage claims allegedly incurred at refinery during equipment extraction process. The case was settled on the eve of trial under terms favorable to the client.; Represented domestic oil & gas producer in $100 million title dispute case involving bad faith trespass claims, alleged rescission of ratifications of leases, and contract interpretation issues related to multiple competing JOA's. The trial court granted declaratory relief in favor of Mr. Guerino's client.; Represented a national directional drilling company in breach of contract claims involving a multimillion, 12 well horizontal drilling program. The litigation was submitted to binding arbitration in Atlanta, Georgia. The client prevailed on all counts.; Represented the defendant in a major pipeline rupture case in which hundreds of local residents were evacuated following the explosion of a 6 propylene pipeline. Following a two week jury trial, a verdict was entered in favor of the client.; Defended an international energy company against claims of negligent performance and breach of contract regarding down-hole well operations. The jury ruled for Tony's client on all counts, and further awarded his client damages on their counter-claims.; Represented a major oil and gas exploration and production company in its claims against a well services company for loss of a prolific well producing from multiple pay zones. The case was settled with the client receiving a multimillion-dollar settlement in excess of the value his client placed on the case.; Represented Fortune 100 energy company in connection with international arbitration claims involving the construction of a $500 million offshore floating production storage and offloading (FPSO) facility to be installed off the coast of Nigeria. The case settled with Tony's client receiving concessions valued in the tens of millions of dollars from contractors located on numerous continents.; Defended Cyprus Amax Minerals Company, and its parent, Phelps Dodge, Inc., the largest mining company in the world, against property contamination claims resulting from oilfield operations on plaintiff's 700-acre ranch. Damages of several million dollars were claimed. Following a three week jury trial, a defense verdict was entered in favor of Tony's client.; Defended an international E&P company from multimillion-dollar groundwater and soil contamination claims. After discovery of technical flaws and issues in plaintiff's claims, Tony was instrumental in negotiating a nuisance value settlement.; Created and implemented a litigation strategy that persuaded plaintiff's to non-suit and/or dismiss his clients from asbestos related toxic tort litigation involving hundreds of claims and multiple defendants.; Represented Fortune 500 corporation from third-party claims that the corporation was the alter ego of, or in single business enterprise with, predecessor companies alleged to have committed breach of contract, fraud and/or negligence. A unanimous jury verdict was awarded for Tony's client.; Obtained take nothing judgment in favor of a major oil company against royalty dispute claims, exceeding several million dollars, asserted by a mineral interest owner.; Obtained numerous favorable summary judgments involving various types of oil and gas agreements including joint operating agreements, master service agreements, drilling contracts, farmout agreements, exploration agreements constraint agreements and royalty agreements.; The above representations were handled by Mr. Guerino prior to his joining Greenberg Traurig, LLP.
