Tony Guerino is an energy and environmental trial lawyer who focuses his litigation and arbitration practice on resolving disputes related to oil and gas exploration and production. He has more than 20 years of experience as lead counsel in energy-related matters throughout the United States and major producing areas around the globe. His background as a petroleum engineer and executive with a large international oil & gas exploration and production company provides him with a deep understanding of the legal and technical issues relevant to the oil & gas industry. He brings strategic guidance and practical experience to his clients. He routinely assists his clients to evaluate and monitor risk and liability concerns at the contract drafting and negotiation stage of domestic and international projects.
Oil and Gas Industry Knowledge and Experience
In addition to his proven courtroom and arbitration skills, Mr. Guerino is a petroleum and natural gas engineer who worked for a major exploration and production company, learning the technical and financial intricacies of the energy business prior to earning his law degree. This unique combination of petroleum engineering and legal skills, along with in-depth knowledge and hands-on experience in the energy industry as an operations engineer, production engineer, reservoir engineer and positions in senior management responsible for onshore and offshore operations, makes Mr. Guerino one of Texas' go-to energy litigators. Mr. Guerino has represented major exploration & production companies, oilfield services companies, drilling companies, independent operators and pipeline companies in energy litigation and arbitrations around the country involving hundreds of millions of dollars.
Energy-Related Contract Disputes
Mr. Guerino has wide-ranging and varied experience in energy industry contract disputes including Joint Operating Agreements, Master Service Agreements, Purchase and Sale Agreements, Royalty Agreements, Production, Transportation and Storage Agreements, FPSO related agreements, Field Development Agreements, and other oil and gas industry agreements.
Property Contamination and Trespass (Fracking Issues)
Mr. Guerino represented an oil and gas operator against multimillion-dollar property contamination claims allegedly resulting from his client's oilfield operations and completion techniques, including fracking. After discovery of technical flaws and issues in the plaintiff's claims, Mr. Guerino was instrumental in having the case dismissed. Mr. Guerino has represented multiple companies with respect to horizontal drilling issues, including underground trespass and contamination claims.
Mr. Guerino has represented oil & gas equipment producers and suppliers, casing and tubing manufacturers, E&P companies, operators and working interest owners in cases involving a myriad of drilling issues, downhole operations, and oil and gas equipment failures. His strong technical knowledge of the energy industry is routinely used to his client's advantage in downhole oil and gas well matters.
Mr. Guerino has broad experience in the prosecution and defense of royalty claims. Most recently Mr. Guerino has represented E&P companies, company officers and individual royalty owners with respect to royalty disputes in the Eagle Ford shale involving claims valued at more than $700 million dollars throughout multiple Texas state courts.
Trade Secret Litigation
Mr. Guerino has litigated numerous matters involving trade secrets, unfair competition, misappropriation, industrial espionage and employee raiding, both on behalf of plaintiffs and defendants. Through the benefit of his degree in engineering, coupled with his engineering experience, he has a deep understanding of his client's technology and competitive environments. Representative matters have involved highly specialized chemical plant, refinery equipment, and downhole oil & gas tools. He has experience in developing protocols to avoid misappropriating others' trade secrets related to the movement of senior level industry employees and in assisting clients who need to protect their trade secrets.
