Biography

Tracey K. Merwise is a Shareholder in the San Francisco office of Jackson Lewis P.C.

Ms. Merwise provides clients with strategic litigation defense of individual and class-action cases. In addition, she is a Certified Workplace Conflict Mediator and assists companies in de-escalating workplace disputes and in handling performance management, employee leaves and reasonable accommodation issues to help ensure legal compliance and to minimize the likelihood of litigation.

Prior to joining Jackson Lewis, Ms. Merwise was a Partner and Co-Chair of the Labor and Employment Practice Group at Severson & Werson, APC, served as Senior In-House Counsel in the Employment Department at SBC Communications, Inc. (now AT&T), and was an associate at the law firms of Heller Ehrman and Seyfarth Shaw.

She is a frequent speaker before business and employer associations, including Financial Executives International (FEI), the Financial Women's Association of San Francisco, the San Francisco Chapter of the American Society for Women Accountants (ASWA), and clients of insurance brokers including Woodruff Sawyer, Hays Company, and CCI Financial & Insurance Services. Ms. Merwise frequently speaks to employers about how to avoid some of the most common employment-law mistakes, how to conduct lawful and effective reductions-in-force, and how to handle leave and reasonable accommodation issues.

Ms. Merwise authored Proactive Measures: Helping Your Company Avoid Retaliation Claims for 8-K Magazine: The Legal Magazine For Business Executives in 2006. She has also authored and co-authored articles on important legal decisions in the areas of wage and hour law, employer monitoring of employees' use of electronic media, and city, state and federal legislation issues.

Ms. Merwise has been recognized as an Outstanding Volunteer in Public Service by the Bar Association of San Francisco (BASF) for her work with the BASF's Housing Negotiation Project. She is a member of the American Bar Association's Labor & Employment and Alternative Dispute Resolution Sections, the Bar Association of California's Labor & Employment and Alternative Dispute Resolution Sections, the Bar Association of San Francisco and the Society for Human Resource Management (SHRM).

Ms. Merwise received her B.A. in Government cum laude from Dartmouth College and her J.D. from Harvard Law School. After law school, she clerked for the Honorable John W. Bissell, U.S. District Court for the District of New Jersey.
