Trenam Kemker’s Construction Law and Government Contracting practice represents clients in every facet of the construction industry, including private owners, developers, and general  or trade contractors. From negotiating and documenting construction contracts, to counseling during construction and contract disputes, our attorneys offer practical advice to clients in every stage of the process throughout the life of each project. We help clients avoid the high cost of litigating construction and government contracting disputes.

The Construction Law and Government Contracting attorneys  provide a full array of services in the realm of project formation, including advice on construction contracts and forms from all of the major professional and industry organizations. We also provide counsel on legal agreements for all construction needs such as joint venture and teaming agreements, design-build contracts, construction management agreements, retention of design professionals, and technical assistance agreements.

We are experienced in the range of delivery options and the risks inherent in each, whether it is design/build, general contactor, construction manager, project manager, or engineer-procure-construct. We handle the related issues of bidding documents, completion guarantees, performance guarantees, construction lending, credit enhancement, and construction liens. In the area of Dispute Resolution, Trenam Kemker is an active member of the American Arbitration Association and our attorneys routinely participate in various types of alternative dispute resolution proceedings, including arbitrations, mediations, dispute review boards, mini-trials, structured negotiations and other forms of expedited processes to resolve disputes efficiently and at low cost. Our attorneys represent clients on construction matters before all tiers of the federal and state court systems and administrative agencies, and the contract appeals boards. We also offer counsel in private, court-supervised, commercial, labor, international and domestic construction arbitration proceedings.
The Construction Practice Group represents several federal government contractors on a wide variety of matters, including claims and dispute resolution; bid protests; Armed Services Board of Contract Appeals and Court of Claims litigation; general advice before, during, and after the performance of government contracts; cost and pricing audits; and resolution of contract disputes with subcontractors. In addition, our attorneys are experienced in qui tam and other government contracting fraud matters, representing both whistleblowers and government contractors in such cases.
